NAC Shop Customer Terms of Service
These Terms of Service govern access to and use of NAC Shop, including the mobile app, customer website, wallet services, shipment coordination, custom-clearing support, installment sales, rewards, digital service activation, and related customer communications. NAC Shop is operated as a controlled customer sales channel under NAC Travel International and is intended to centralize ordering, payment routing, customer support, and delivery coordination between South Africa and Malawi.
By creating an account, browsing as a registered customer, adding items to cart, placing an order, funding a wallet, requesting a withdrawal, using any installment option, redeeming NAC Rewards, or requesting support, you acknowledge that you have read, understood, and accepted these terms. If you do not agree, do not use the service.
1. Eligibility, identity, and account integrity
You must provide true, complete, and current registration information, including your full name, email address, phone number, delivery details, and any identity or compliance documents that NAC Shop may reasonably request. NAC Shop may suspend, limit, or close an account where information is inaccurate, misleading, fraudulent, inconsistent with verification records, or creates operational, compliance, payment, customs, or legal risk.
You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out using your account. NAC Shop is entitled to rely on instructions received through your authenticated account unless and until you prove unauthorized access in a manner satisfactory to NAC Shop. The company may deny, hold, or reverse transactions where fraud, duplicate orders, chargeback exposure, sanctions concerns, source-of-funds risk, or identity doubt exists.
2. Product listings, availability, and pricing
All products, offers, and descriptions are subject to availability, supplier confirmation, stock changes, pricing updates, customs treatment, route constraints, and delivery feasibility. A product shown in the catalog does not guarantee immediate availability or guaranteed dispatch. NAC Shop may correct pricing, title, image, description, or route details at any time before order confirmation where information is incomplete, stale, or affected by supplier or treasury movements.
Displayed prices may be shown in ZAR, MWK, or both. Where a converted figure is displayed, that converted amount is for customer convenience and uses NAC Shop’s then-current internal display rate. Because cross-border procurement, supplier settlement, route planning, and treasury conversion can change, the final amount due may differ where the customer has not yet completed payment or where a manual verification route has been selected.
3. Orders, supplier sourcing, and procurement risk
Some catalog items are supplied directly by NAC Shop and others are fulfilled through approved suppliers or controlled sourcing partners. NAC Shop remains the customer-facing contracting channel, but it does not warrant that third-party supplier stock, packaging, specifications, warranty terms, origin documents, or procurement times will remain static. NAC Shop may substitute a comparable sourcing route, delay confirmation, request customer instructions, or cancel the order and refund eligible settled amounts where supply becomes unavailable or commercially unreasonable.
For supplier-sourced items, custom goods, digital services, large-format electronics, second-hand goods, and fragile products, procurement may begin immediately after payment confirmation or installment approval. Once procurement or route allocation begins, cancellation rights may be restricted and additional supplier-specific conditions may apply.
4. Delivery, transport, customs, and customer responsibilities
NAC Shop may route goods by plane, bus, truck, or another controlled route that NAC Shop deems commercially and operationally suitable. Delivery windows are estimates only. They are not guaranteed timelines and may be affected by customs inspection, route consolidation, weather, border congestion, aircraft or vehicle scheduling, supplier delays, payment verification, public holidays, strikes, security events, or force majeure.
Unless NAC Shop expressly states otherwise in writing, customs duty, VAT, inspection fees, release fees, storage charges, brokerage charges, penalties, demurrage, port fees, or any border-related government or third-party charges are excluded from standard product pricing. The customer bears ultimate responsibility for lawful import eligibility, destination restrictions, permits, and any taxes or duties assessed by authorities. NAC Shop may assist with customs handling as a service, but it does not guarantee duty rates, release times, or customs outcomes.
The customer must provide accurate pickup, collection, or delivery details and make themselves available when contacted. NAC Shop is not responsible for failed delivery, loss escalation, additional storage, or re-routing costs caused by incorrect addresses, unreachable phone numbers, refusal to cooperate with customs or delivery requirements, or failure to collect in time.
5. Fragile goods, second-hand goods, and special-risk goods
Fragile goods, breakable items, high-value electronics, second-hand goods, and selected supplier-sourced items carry elevated operational and legal risk. By ordering such goods, the customer accepts that cosmetic defects, packaging wear, previous-use condition, minor non-material variance, route vibration, power compatibility issues, or supplier grading disputes may arise despite reasonable care. NAC Shop may require additional product-specific acknowledgements before proceeding.
Second-hand goods are sold subject to condition disclosures, supplier grading, and availability at source. Unless expressly stated, second-hand goods are sold on a limited-risk basis and may not carry original manufacturer warranties. The customer is responsible for reviewing the product description, route exposure, and any disclosed limitations before ordering.
6. Wallets, rewards, and non-cash benefits
The NAC Shop wallet is a customer convenience mechanism for approved fiat balances in supported currencies. Wallet balances are not bank deposits, investment products, or insured savings accounts. Wallet access may be restricted pending verification, compliance review, or treasury reconciliation. NAC Rewards are a closed-loop loyalty feature and are not cash, e-money, cryptocurrency, tradeable tokens, securities, or withdrawable assets. Rewards may be granted, limited, expired, adjusted, or removed in accordance with promotional rules and fraud controls.
NAC Shop may reverse balances, suspend rewards, or block redemption where abuse, duplicate accounts, return fraud, self-dealing, payment reversals, or policy misuse is detected.
7. Installment sales and title retention
Where installment access is offered, it is offered solely at NAC Shop’s discretion and remains subject to product eligibility, wallet/payment history, KYC status, source-of-funds checks, treasury comfort, and contract acceptance. NAC Shop may approve, reject, amend, or withdraw any installment option at any time before final confirmation. Goods purchased on installment remain under NAC Shop’s title control until the entire approved installment obligation, together with any approved fees or adjustments, has been settled or otherwise lawfully waived in writing.
Failure to make payment on time may result in collection action, suspension of benefits, cancellation of release, withholding of goods, blacklisting within the NAC Shop ecosystem to the extent permitted by law, or legal enforcement where applicable. NAC Shop reserves the right to accelerate amounts due where material default or fraud risk arises.
8. Digital services and service activation
Digital services such as account setup, subscription support, online renewals, hosting payments, or remote service activations are fulfilled subject to third-party provider rules and payment verification. NAC Shop acts as a controlled facilitation and support channel and does not guarantee that any third-party platform will accept, renew, or maintain service beyond the period successfully activated.
Once a digital service has been fulfilled, activated, credited, or delivered to the customer or to the customer’s nominated account, the service is generally non-refundable unless the failure was caused solely by NAC Shop and no third-party value was consumed.
9. Limitation of liability and indemnity
To the maximum extent permitted by applicable law in South Africa, Malawi, and any relevant destination jurisdiction, NAC Shop, NAC Travel International, their directors, employees, contractors, sourcing partners, agents, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss, including loss of business, reputation, data, savings, opportunity, or anticipated profits. NAC Shop’s aggregate liability for any claim relating to a product or service will, where liability is established, be limited to the amount actually paid to NAC Shop for the affected item or service, excluding external taxes, government fees, and third-party charges.
You agree to indemnify and hold NAC Shop harmless against claims, penalties, costs, losses, customs issues, route disputes, or third-party demands arising from your inaccurate information, unlawful import, misuse of the service, breach of these terms, fraud, chargeback abuse, infringement of third-party rights, or failure to comply with customs, payment, or collection obligations.
10. Governing law, operational control, and amendments
These terms are governed with reference to the operational laws applicable to NAC Shop’s business structure, including relevant commercial, consumer, privacy, and compliance rules in South Africa and Malawi, while also respecting any mandatory rules of the customer’s destination jurisdiction where required by law. NAC Shop may update these terms at any time to reflect product, wallet, route, customs, legal, or platform changes. Continued use of the service after an update constitutes acceptance of the revised terms.
If any clause is unenforceable, the remaining provisions remain in force. A failure by NAC Shop to enforce any right immediately does not amount to a waiver. These terms, together with any product-specific terms, installment contracts, wallet terms, privacy policy, refunds policy, and route-specific notices, form the complete agreement between the customer and NAC Shop.
